Kaspersky fails in court

In a recent blog post of ours, we reported about the warning issued by the BSI (German Federal Office for Information Security), which advises against using Kaspersky antivirus software for security reasons and recommends alternatives as replacement.

Now the Russian manufacturer of the anti-virus software Kaspersky tried before the Cologne Administrative Court to overturn the BSI's warning and also to prohibit the BSI from making such statements in the future. This emergency application failed in court and the BSI may continue to warn against Kaspersky's virus protection software.

The Cologne court explained that the legislature had defined the term "security gap" broadly, which justified the BSI's warning. If the required high level of trust in the manufacturer is no longer guaranteed, a security gap exists.

From the court's point of view, Kaspersky's security measures do not provide "sufficient protection against state interference". Moreover, it cannot be assumed that state actors in Russia will abide by laws that do not allow Kaspersky to share data. Russian developers could also misuse the antivirus software for cyberattacks on their own initiative or under pressure from other Russian actors.

FCC adds Kaspersky Labs to list of national security threats

Even more pressure on Kaspersky! The BSI is no longer alone with its warning, because the US Federal Communications Commission (FCC) has now added Kaspersky Labs, among others, to its list of national security threats.

Kaspersky Labs was reportedly first added to the list to protect networks from threats and state-backed Russian organizations seeking to spy on and otherwise harm America's interests.

The US authorities have long believed that the use of Kaspersky software could open up American networks to malicious activity from Moscow. For this reason, Kaspersky software products were banned from government networks back in 2017.
